RE: The Classification of Tungsten Carbide Cobalt Chromium Powder from Germany

Dear Mr. Constantine:

In your letter dated February 2, 2016, you requested a tariff classification ruling for tungsten carbide cobalt chromium powder. Specifically, you request classification rulings for the seventeen products listed below.

Metco™ 5163, Metco™ 5164, Metco™ 5165, Metco™ 5847, Metco™ 5847-45, Woka™ 3651, Woka™ 3652, Woka™ 3652 FC, Woka™ 3653, Woka™ 3653 FC, Woka™ 3654, Woka™ 3654 FC, Woka™ 3655, Woka™ 3657, Woka™ 3660 FC, Woka™ 3661 FC, and Woka™ 3665.

These products differ both in primary carbide grain size and by percentage of total product for the cobalt (between 8.5% and 11.5%), Chromium (between 3.2% and 4.8%) and Carbon (between 4.8% and 5.6%). The remaining balance of the product is tungsten. These differences do not affect the tariff classification

You state this product is a thermal spray powder, it is spheroidal, agglomerated, and sintered. The cobalt-chromium matrix functions as a binder material for the carbide particles. During the manufacturing process, the product passes through a sintering process. The tungsten carbide is mixed with the binder and sintered. After sintering, the sinter cake is broken/milled to attain a powdery product for further use as a thermal spray coating.

The applicable subheading for the tungsten carbide cobalt chromium powder will be 8113.00.0000 Harmonized Tariff Schedule of the United States, (HTSUS), which provides for cermets and articles thereof, including waste and scrap. The rate of duty is 3.7 percent of the value.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
